Simple, but effective rules.
This document is for certain legal responsibilities for Ultrahoster web services which includes servers under the domains ultrahoster.co.uk, ultrahoster.org.uk. These terms are for use of the server, hardware, software and any other equipment used for the services.
By using Ultrahoster web Services you agree to the following terms and not using them will lead to further penalties such as account suspention, account termination or higher penalties depending on the situation.
Under no circumstances shall Ultrahoster or any other party involved in creating, producing, or distributing Ultrahoster be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of or inability to use Ultrahoster, including but not limited to reliance by you on any information obtained from Ultrahoster or that result from mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, delays in operation or transmission, or any failure of performance, whether or not resulting from acts of God, communications failure, theft, destruction, or unauthorized access to Ultrahoster's records, programs, or services. You hereby acknowledge that this paragraph shall apply to all content, and services available through Ultrahoster. Due to the fact that some states do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states liability is limited to the fullest extent permitted by law.
Information on this web site may contain technical inaccuracies or typographical errors. Information may be changed or updated without notice. Ultrahoster may also make improvements and/or changes in the products and/or the programs described in this information at any time without notice.

ULTRAHOSTER'S RIGHTS
Ultrahoster's rights include but are not limited to the below paragraphs. Ultrahoster may elect to monitor any areas of the site or any of its services and may disclose any content, records, or electronic communication of any kind to satisfy any law, regulation, or government request or if such disclosure is necessary or appropriate to operate Ultrahoster or to protect the rights or property of Ultrahoster, its visitors, sponsors, providers, licensers, or merchants.
Ultrahoster is not responsible in any way whatsoever for screening, policing, editing, or monitoring such content. If notified of allegedly infringing, defamatory, damaging, illegal, or offensive content, Ultrahoster may investigate the allegation and determine in its sole discretion whether to remove or request the removal of such content from Ultrahoster.
Ultrahoster reserves the right to prohibit conduct, communication, or content that it deems in its sole discretion to be harmful to individual users, Ultrahoster, or any rights of Ultrahoster or any third party, or to violate any applicable law.
Not withstanding the foregoing, neither Ultrahoster nor its providers, merchants, sponsors, or licensers can ensure prompt editing or removal of questionable content after online posting. Accordingly, neither Ultrahoster, nor its affiliates, nor any of its officers, directors, employees, or agents, nor provider, merchant, sponsor, or licenser shall assume liability for any action or inaction with respect to conduct communication, or content on Ultrahoster.
SERVER USE
Limitations. The Service is subject to the following limitations:
Shared Web Hosting, Reseller Web Hosting Plans
CPU Resources. User acknowledges that the Service is provided on a shared server and agrees not to engage in any activity that could overwhelm the server with heavy CPU usage, memory usage, or that requires a disproportionate amount of the resources of the Ultrahoster's server, including without limitation, use of highly active PHP scripts or MySQL processes.
Reselling without reseller account. All features of your account are to be used by the account holder only and not redistributed to the internet community. You may not install any large file uploading scripts or file managers which store large public uploaded files on your webspace, without obtaining permission from Ultrahoster. You may not give out your FTP or account login password to anyone who is not related to webmastering your web site, nor may you give out your password for the purpose of public uploads or download. You may not sub host/resell or run your own web hosting provider on our servers, this included providing an account or website to persons who were rejected from signing up at our site or banned from creating accounts for any reason.

User shall not include content, or internet links to content on the Site that contain, promote or involve any of the following:
Any infringement of copyright, trademark, patent, trade secret or other intellectual property right;
Hate propaganda;
Racist, threatening, or otherwise abusive content;
Any sorts of pornography;
The promotion or incitement of, or instruction for, the commission of illegal activities;
Mail fraud, multi-level marketing (pyramid) schemes or any other fraudulent activities;
Content promoted through the sending of unsolicited e-mail (also known as spamming);
Sending of unsolicited e-mail (spam) from the Ultrahoster server, or any other server that refers to content on the Ultrahoster server, or sending such e-mail with a Ultrahoster hosted Web site listed as the contact address;
Warez, cracks, hacks, spam software & their associated utilities;
Information or other material that contains a virus, corrupted data or any other harmful or damaging component;
Any files protected with "camouflage", "banana" or any other deceptive method to hide the true content of the file, or to hide a file inside another file;
Any websites which promote illegal downloads including movies, games, music or any other type of illegal file sharing activites.
Any files which are known to be unsafe to the server or may cause the server to go down.
User agrees that Ultrahoster is not responsible for content on pages hosted on member sites and acknowledges that Ultrahoster does not endorse or verify any such material.
User agrees to assume full responsibility for all files associated with the Site and acknowledges that User may be held legally for the contents of the Site.
Accounts, in our sole descretion, conciders to be storing only or mostly downloadable files are not allowed without permission and may be terminated.
Virtual Private Servers & Dedicated Server Plans
Illegal Usage Restrictions: Resources provided by Ultrahoster may be used only for lawful purposes. Examples of unlawful content include, but are not limited to:
unlicensed hosting of, linking to, or any involvement in the transmission of copyrighted media, applications, published works, or any data protected by trade secret, without sufficient
rights to engage in this activity
child pornography and/or kidnapping material
content deemed to be terroristic in nature
material posted to incite violence
violations of human and animal rights, including the display of acts of cruelty and other abuse
pyramid/ponzi schemes
fraudulent sites and other forms of phishing (emails/forms/sites used to gather personal information from unsuspecting individuals)
cracking programs and/or key generators
violations of import/export restrictions
Prohibited Usage Restrictions: In addition to activities governed by law, Ultrahoster strictly prohibits:
IRC and associated applications (including bouncers, "bots", etc.)
malware (malicious software) and/or botnets
network and systems abuse scripts
circumvention of and/or provision of instructions to circumvent security measures
unnecessary port scans
threatening, harassing, or obscene content
anonymizers/proxies without password protection and sufficient logging (including open mail proxies, anonymous web surfing proxies)
proxy detection scripts
unsolicited and/or mass advertising via forums, blogs, comment forms, and newsgroups
mail bombing, email address harvesting, and/or unsolicited email (including bulk mail sent to unconfirmed recipients and individual unsolicited advertisement or link exchange
requests)
HYIPs (high-yield investment programs)
excessive overutilization of resource limits
evasion of bans or blacklistings by changing domains/IPs
Bulk Email & Blacklisting: Ultrahoster understands that bulk email is an important mechanism for keeping people informed. However, spamming from the Ultrahoster network, and spamvertising (unsolicited advertising of) sites hosted on the Ultrahoster network, is prohibited. Legitimate bulk email meets the following criteria:
ALL recipients have confirmed willingness to be added to a distribution list by clicking on confirmation links or (preferably) by responding to verification emails.
Distributed messages include valid headers, removal instructions, and information on the method by which the subscribed addresses were obtained.
The usage of partially confirmed recipient lists is not allowed. All bulk email senders must post privacy policies and must be clearly identified to recipients during the subscription and
confirmation process. The usage of third-party distribution lists is prohibited. If Ultrahoster approaches a client for evidence of confirmation, the request must be honored within 48
hours of the initial spam alert. Deactivation of an account or service may be required, until proof of confirmation is provided and approved. Ultrahoster reserves the right to require
termination of any services involved in the transmission of unsolicited email.
If any terms are violated, the involved client/reseller may be charged an abuse fee of £60.
TERMINATION OF THIS AGREEMENT
This agreement is effective until terminated by either party.
You may terminate this agreement at any time, by logging in to your account at Ultrahoster, and click the "Cancel Account" or contact us to request account cancellation.
In addition, by providing material on our web site, we do not in any way promise that the materials will remain available to you. Ultrahoster is entitled to terminate all or part of any of its site or services at any time, without notice to you. Ultrahoster is also allowed to delete content of the Ultrahoster servers if terms not followed.
This document remains the property of Ultrahoster and Ultrahoster hold the rights to have this document modified, deleted or re created at any time without notice.
